A federal judge on Wednesday extended a temporary restraining order preventing the Biden administration from canceling the use of a Section 42 public health order to deport immigrants at the border until the May 23 end date and a hearing on the preliminary request. The ban will be issued later this week.
The U.S. Centers for Disease Control (CDC) announced last month that it would end the public health order at the end of May.
That immediately sparked concerns among Republicans and Democrats that it would not only lead to the release of more immigrants to the interior of the U.S., but also encourage more immigrants to come to the border. The Department of Homeland Security acknowledged those concerns and said it was planning a dramatic increase in immigration, by as much as 18,000 immigrants a day.
In response, 21 Republican states, led by Arizona, Missouri and Louisiana, sued, arguing that repealing the order violated the Administrative Procedure Act and would be negative for their states due to the ensuing immigration numbers Influence.
