Every summer, we Barnett/Blackman Casebook. In recent years, we have attempted to edit the case on the same day the case was decided. This year, back-to-back Dobbs/Bruen drops have delayed our schedule. We have now completed our review. Below are nine cases from the supplementary material.
What an important term! If I had to predict, about half of these cases would make it to the fifth edition of the casebook. Dobbs veto roe. Carson completed the trilogy that started Trinity Lutheran and Espinosa. Kennedy finally buried lemon,more importantly, eliminated lemon defense. Brunn Finally decided on unresolved issues Heller and McDonald’s. Torres v DPS May represent a new split in courts with sovereign immunity.and West Virginia May be the first step (or at least a half step) to reinvigorating the non-delegation principle.
The fifth edition of the casebook should be published in 2026—just in time for the half-500th anniversary. What will the constitution look like on the 250th anniversary of the Declaration of Independence?
