Representative David Cicilline, backed by 40 other House Democrats, introduced legislation that would cite a Civil War-era provision of the 14th Amendment to bar Donald Trump from holding public office.
Cicilline proposed HR 9578, which seeks to find Trump “ineligible to serve as President of the United States again or to hold any civil or military office in the United States.”
Forty Democratic co-sponsors have check in bill. Oddly, the group has only one original member – Rep. Ayanna Pressley (D-MA) as a co-sponsor.
“Donald Trump was very clearly involved in the January 6, 2021 insurrection to overturn the lawful and fair outcome of the 2020 election,” Cicilline said in an unsubstantiated statement. “You can’t lead a government that you’re trying to destroy.”

Cicillin sent a letter to a colleague Just weeks ago, a bill was outlined and required co-sponsors to take steps that “would prevent Donald Trump from holding public office again under the Fourteenth Amendment.”

Cicilline uses GOP senator’s own words to suggest Trump is responsible for small group of his supporters — as he urges them to protestpeacefully’ — out of control, thereby fomenting an uprising.

but there yes Questions about how Trump’s speeches amount to taking responsibility for the actions of others.
Trump wasn’t even at the scene of the riot, so he can’t be charged for what he did at the Capitol.
Section 3 of the 14th Amendment, a rarely invoked Civil War-era provision, prohibited individuals from holding public office who “participated in an insurrection or rebellion” or “provided aid or comfort to an enemy.”
In other words, mostly high-level allies.
Trump was impeached on charges of “sedition” in January 2021, but was eventually acquitted by the Senate.
Acquitted. The discussion is over. The matter would be laughed out of court in record time.

Not to mention the dangerous precedent that such legislation would open the floodgates. After all, the Democrats themselves have opposed the electoral process in numerous past elections:
- 15 Democrats Opposed to counting Florida’s electoral votes in 2000.
- 31 Democrats voted for Rejected Ohio’s electoral vote in 2004.
- 7 Different Democrats against 11 times Prove the results of the 2016 presidential election.
Still, Democrats will have to schedule a vote on Cicilline’s bill before the end of next week’s legislative schedule. With the Republican-controlled House of Representatives set to take over in January, the 14th Amendment strategy looks likely to fail.
